DMCA & Copyright Policy

VoxLinker respects the intellectual property rights of others and expects our users to do the same. This policy outlines the procedures for reporting copyright infringement and responding to such claims in accordance with the Digital Millennium Copyright Act (DMCA).

1. Policy Statement

It is VoxLinker's policy to respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the VoxLinker platform, please notify our designated Copyright Agent as set forth below.

VoxLinker may, in appropriate circumstances and at its discretion, terminate the accounts of users who are found to be repeat infringers.

2. Notification Process

If you are a copyright owner, or an agent authorized to act on behalf of one, and believe that material hosted on VoxLinker infringes your copyright, you must submit a written notice containing the following elements to our Designated Agent:

Required Elements of a DMCA Notice:

  1. Physical or Electronic Signature: A signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple works are involved, a representative list of such works.
  3. Identification of Material: Identification of the material that is claimed to be infringing (e.g., specific URLs, user profiles, or content IDs) and information reasonably sufficient to permit us to locate the material.
  4. Contact Information: Your address, telephone number, and email address.
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Once we receive a compliant DMCA notice, we will expeditiously remove or disable access to the material claimed to be infringing and notify the user who posted the material.

3. Counter-Notification

If you believe that material you posted on VoxLinker was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent containing the following:

Required Elements of a Counter-Notice:

  1. Physical or Electronic Signature: Your signature.
  2. Identification of Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Consent to Jurisdiction: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or California if outside the US), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we may restore the removed material after a waiting period of 10-14 business days, unless the copyright owner notifies us that they have filed an action seeking a court order to restrain the user from engaging in infringing activity.

4. Repeat Infringer Policy

VoxLinker has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users of the platform who are deemed to be repeat infringers.

A "repeat infringer" is a user for whom we have received more than one valid DMCA notice of infringement. In such cases, we reserve the right to terminate the user's account, delete their content, and forfeit any unpaid commissions.
